Fostermom2- do you happen to know where I can buy Room Shocker?
I looked all over online for a place to buy it locally so I could get it quicker.
Can’t seem to find any place to buy it besides online. Thanks so much. Lot’s of good reviews.

I saw that, too, but I’m not one to toot my own horn. Besides, knowing my luck, it won’t last and if I say any more about it, I’ll jinx myself.
Olive // November 8, 2009 at 12:00 pm
At least give yourself a pat on the back Dave, you earned it! I hope you are feeling better today. Did you read the new Hinkymeter article? It’s quite interesting.

Thank you, Olive. No, I haven’t read it yet. I’ll go there now.
Oh… yes, I am feeling better today, thank you.

Hi Dave – Glad to see you up and about. Hope you are feeling much better today. Was also glad to see that you are holding your own in the poles.
I have to say, your Florida DP laws are quite interesting. Now I really understand why the defense is so up in arms about the DP being on the table. It is a lot tougher to get 12 people to agree to the DP, but when SAO is only looking for a simple majority, the odds move much more in their favor. Especially in a case of this nature.
I also saw where the Florida Supreme Court has made some recent rulings regarding the DP.
Marinade Dave // November 8, 2009 at 12:08 pm
Thank you, Snoopy. Definitely, you can poot, I mean toot, for me. I will behave myself. Promise.
Marinade Dave // November 8, 2009 at 12:12 pm
I am feeling better, today, Vicky. Thank you.
Florida is strange in that regard. I would think a DP penalty should be unanimous, but in the end, it’s the judge who makes the final decision.

Hi there Vicky…toot toot LOL
Listen to Dave, he is our teacher!!

Hey! My new AT&T Yellow Pages book has a John Morgan refrigerator magnet on it. Whoopee!
Olive // November 8, 2009 at 12:20 pm
Dave, is it true that there is a separate jury for the sentencing phase? I was under the impression that it was the same jury from the trial.
Marinade Dave // November 8, 2009 at 12:22 pm
It’s the same jury. A DP trial is set up in 2 phases. The guilt or innocence phase and the life or death phase if the defendant is found guilty. That’s one of the reasons why the DP is asked for, to seat a jury that would be willing to execute someone.
Weezie // November 8, 2009 at 12:23 pm
If it’s up to da Judge, let us hope he is on Caylee’s side. I am happy that DP doesn’t have to be “majority rules”, because in the end it should be the preponderance of guilt, not whether 12 jurors agree to DP in principle.
Vicky // November 8, 2009 at 12:25 pm
I’m Sorry Olive – I was answering the question you asked about if the jury couldn’t arrive at a decision. At that point Iwas under the misguided notion that the DP had to be unanimous. Sorry about that. A second jury can be impaneled to sentence the defendant if the guilt phase jury is not avaulable.
I found this ruling by the Florida Supreme Court last night while making myeslf familiar with Dp in Florida. It’s kind of long, but worth the read.

Weezie // November 8, 2009 at 12:26 pm
Dave; In the Scott Peterson trial it was the same jury for both guilty and sentencing. Don’t you remember Strawberry Shortcake? I followed that one pretty closely. Now maybe it’s different in Florida? Not sure.
Weezie // November 8, 2009 at 12:28 pm
Thanks Vicky you just answered my question mark.
Vicky // November 8, 2009 at 12:30 pm
Hi Snoopy – That is why class is usually cancelled if the instructor does not arrive. While Dave was sleeping last evening, I should have been too. LOL
snoopysleuth // November 8, 2009 at 12:32 pm
Dave~~I will get John Morgan to vote for you and Mitnik too…. I’ll tell him he can be your counsel when you become a celebrity. He will work pro bono when he finds out you have him stuck on your frig…
snoopysleuth // November 8, 2009 at 12:37 pm
Vicky~~you did wonderful last night. Florida laws are a tad different than the other states.
Make that tad a big wad… I find their laws interesting though. That Alford plea is another interest and can’t be ruled out completely in this case yet???
Marinade Dave // November 8, 2009 at 12:42 pm
Weezie – It DOES have to be a majority rule, but the judge renders the decision in the end, not the jury. The jury recommends the penalty.
Vicky // November 8, 2009 at 12:49 pm
Snoopy – I don’t think the Alford Plea will be used in this case. Casey’s attorneys have an agenda that goes far beyond this case – IMO.
Don’t get me wrong, it will be a huge feather in their cap if Casey is found not guilty, but if she is, I think they are also hoping for some time before the US Supreme Court to argue certain aspects of the law.
snoopysleuth // November 8, 2009 at 12:51 pm
The judge seldoms overrides the jury in it’s decision in the penalty phase.
snoopysleuth // November 8, 2009 at 12:54 pm
Vicky~~I doubt if Judge Strickland would allow the Alford plea.

Olive // November 8, 2009 at 12:56 pm
I feel very strongly that Judge Strickland will make the correct decision, I have all the faith in the world in him. We could not have asked for a better Judge to oversee this case.
Olive // November 8, 2009 at 12:58 pm
I’d like to add that even if he hands down a sentence that I personally don’t agree with, I feel that he will make the right decision.
snoopysleuth // November 8, 2009 at 12:59 pm
Olive~~it is no secret that I love Judge Strickland. He is intelligent and does his homework. Also, he is fair and excels in having patience with the attorneys.
Shadow // November 8, 2009 at 1:12 pm
What I don’t get, Dave, is why is DISUnplugged on the list twice.
Marinade Dave // November 8, 2009 at 1:31 pm
Good point, Shadow. I think I’m still #2 because of a computer glitch.
snoopysleuth // November 8, 2009 at 1:49 pm
Marinade~~the pages are loading so slow in here and your other post. At my age, can you speed things up and open up a new post so I wont have a birthday before I get to the next milestone?
When are you ever going to houseclean this place and get rid of some superfluous fluff ?
Marinade Dave // November 8, 2009 at 2:12 pm
OK, there’s a new OF page up. It should be fast again.
