    I looked all over online for a place to buy it locally so I could get it quicker. :)

    Can’t seem to find any place to buy it besides online. Thanks so much. Lot’s of good reviews.

    Hi Dave – Glad to see you up and about. Hope you are feeling much better today. Was also glad to see that you are holding your own in the poles.

    I have to say, your Florida DP laws are quite interesting. Now I really understand why the defense is so up in arms about the DP being on the table. It is a lot tougher to get 12 people to agree to the DP, but when SAO is only looking for a simple majority, the odds move much more in their favor. Especially in a case of this nature.
    I also saw where the Florida Supreme Court has made some recent rulings regarding the DP.

    Florida is strange in that regard. I would think a DP penalty should be unanimous, but in the end, it’s the judge who makes the final decision.

    Dave, is it true that there is a separate jury for the sentencing phase? I was under the impression that it was the same jury from the trial.

    It’s the same jury. A DP trial is set up in 2 phases. The guilt or innocence phase and the life or death phase if the defendant is found guilty. That’s one of the reasons why the DP is asked for, to seat a jury that would be willing to execute someone.

    If it’s up to da Judge, let us hope he is on Caylee’s side. I am happy that DP doesn’t have to be “majority rules”, because in the end it should be the preponderance of guilt, not whether 12 jurors agree to DP in principle.

    I’m Sorry Olive – I was answering the question you asked about if the jury couldn’t arrive at a decision. At that point Iwas under the misguided notion that the DP had to be unanimous. Sorry about that. A second jury can be impaneled to sentence the defendant if the guilt phase jury is not avaulable.

    I found this ruling by the Florida Supreme Court last night while making myeslf familiar with Dp in Florida. It’s kind of long, but worth the read.

    Dave; In the Scott Peterson trial it was the same jury for both guilty and sentencing. Don’t you remember Strawberry Shortcake? I followed that one pretty closely. Now maybe it’s different in Florida? Not sure.

    Vicky~~you did wonderful last night. Florida laws are a tad different than the other states.
    Make that tad a big wad… I find their laws interesting though. That Alford plea is another interest and can’t be ruled out completely in this case yet???

    Weezie – It DOES have to be a majority rule, but the judge renders the decision in the end, not the jury. The jury recommends the penalty.

    Snoopy – I don’t think the Alford Plea will be used in this case. Casey’s attorneys have an agenda that goes far beyond this case – IMO.

    Don’t get me wrong, it will be a huge feather in their cap if Casey is found not guilty, but if she is, I think they are also hoping for some time before the US Supreme Court to argue certain aspects of the law.

    The judge seldoms overrides the jury in it’s decision in the penalty phase.

    I feel very strongly that Judge Strickland will make the correct decision, I have all the faith in the world in him. We could not have asked for a better Judge to oversee this case.

    I’d like to add that even if he hands down a sentence that I personally don’t agree with, I feel that he will make the right decision.

    Olive~~it is no secret that I love Judge Strickland. He is intelligent and does his homework. Also, he is fair and excels in having patience with the attorneys.
